1. Description of the Service

BrowserShield is a browser security and protection tool designed to provide additional protection against certain online threats and unwanted content.

Depending on your configuration, browser, operating system, subscription, and available features, BrowserShield may provide features including:

• Website and URL security analysis;
• Phishing and scam detection;
• Malware and malicious-download detection;
• Suspicious website warnings and blocking;
• Content filtering;
• Adult-content filtering;
• Parental controls;
• Screen-time and scheduling features;
• AI prompt and sensitive-information protection;
• Detection of potentially sensitive information before submission (Data Loss Prevention);
• Security notifications and warnings; and
• Other security, privacy, and browsing-related features.

Features may vary by browser, operating system, subscription plan, geographic location, and version of the Service. We may add, modify, restrict, suspend, or discontinue features of the Service at any time.

2. Eligibility

You must be legally capable of entering into these Terms to use the Service.

If you use BrowserShield on behalf of a company, organization, family, or other entity, you represent that you have authority to accept these Terms on its behalf.

If you permit another person, including a child or other household member, to use BrowserShield through your account or device, you are responsible for ensuring that their use complies with these Terms.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use BrowserShield for your personal or authorized business purposes.

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Service except as expressly permitted by us;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except where such restriction is prohibited by applicable law;
• Circumvent or attempt to bypass security features, access controls, or technical restrictions;
• Interfere with the operation or security of the Service;
• Use the Service to develop or operate a competing service;
• Remove proprietary notices or trademarks; or
• Use the Service in violation of applicable law.

4. Security and AI Disclaimer

BrowserShield uses automated security technologies, including rules-based detection, heuristic analysis, machine learning, artificial intelligence, and other automated methods to analyze websites, URLs, downloads, webpage content, and user inputs.

These technologies are not infallible.

BrowserShield may incorrectly identify legitimate websites, files, links, downloads, content, or user inputs as suspicious, malicious, inappropriate, or otherwise unsafe. BrowserShield may also fail to identify or prevent malware, phishing, scams, malicious downloads, data theft, prompt injection, social engineering, inappropriate content, or other threats.

A “safe,” “trusted,” “no threat detected,” or similar result does not guarantee that a website, file, link, download, message, prompt, or other content is safe, secure, trustworthy, or free from malicious or undesirable activity.

Similarly, a warning, block, or suspicious classification does not necessarily mean that the underlying website, file, link, or content is malicious.

AI-assisted and automated results may be inaccurate, incomplete, outdated, misleading, or affected by limitations in the underlying technology, available information, third-party services, or changes to online content. Security threats may also be newly created, modified, disguised, or specifically designed to evade automated detection.

BrowserShield is intended to provide an additional layer of protection and is not a guarantee of protection against all online threats. You remain responsible for exercising reasonable judgment when browsing the internet, downloading files, opening links, entering information, submitting data, or interacting with websites and third-party services.

You should not rely on BrowserShield as your sole security measure for protecting your devices, accounts, data, finances, business, or other assets.

5. No Guarantee of Threat Detection

No security product can guarantee detection, prevention, or blocking of every security threat. BrowserShield may not detect:

• Newly created or previously unknown threats;
• Modified or obfuscated malware;
• Sophisticated phishing or social-engineering attacks;
• Malicious websites that change after analysis;
• Threats delivered through third-party services;
• Threats contained in encrypted or inaccessible content;
• Threats that bypass browser or operating-system controls;
• Zero-day vulnerabilities or exploits;
• Malicious files or downloads that evade automated analysis; or
• Other threats that cannot reasonably be detected using the technologies available to BrowserShield.

We do not represent or warrant that BrowserShield will identify, block, remove, or prevent every threat.

6. AI-Generated and Automated Results

Certain BrowserShield features may use artificial intelligence or automated systems to classify, analyze, summarize, detect, recommend, filter, or otherwise process information.

AI and automated systems may produce incorrect, incomplete, outdated, or misleading results. In some circumstances, such systems may generate or return information that appears authoritative but is incorrect. You acknowledge that automated or AI-assisted results should be independently evaluated before you rely upon or act upon them.

BrowserShield’s AI or automated results do not constitute professional advice, including legal, medical, financial, investment, tax, cybersecurity, or other professional advice.

Where a decision could have significant legal, financial, medical, safety, employment, educational, or other consequences, you should obtain appropriate professional advice and should not rely solely on BrowserShield or its automated results.

7. False Positives and False Negatives

BrowserShield may produce both false positives and false negatives:

• A false positive may cause BrowserShield to warn about, restrict, or block legitimate content.
• A false negative may cause BrowserShield to permit or fail to identify content that is malicious, harmful, inappropriate, fraudulent, or otherwise undesirable.

You acknowledge and accept these inherent limitations of automated security and content-detection technologies.

8. Parental Controls and Content Filtering

BrowserShield may provide parental controls, content filtering, SafeSearch-related features, screen-time controls, schedules, or other tools intended to assist parents and guardians.

These features are supplemental tools and are not guaranteed to identify or block all inappropriate, explicit, harmful, offensive, or otherwise undesirable content. Children or other users may find ways to bypass, disable, evade, or circumvent filtering or other restrictions.

BrowserShield is not a substitute for parental supervision, education, communication, or reasonable safeguards.

Parents and guardians remain responsible for supervising minors and determining whether BrowserShield and its features are appropriate for their circumstances.

9. Third-Party Websites and Services

BrowserShield may interact with, analyze, link to, or rely upon third-party websites, applications, APIs, AI services, browsers, operating systems, payment processors, hosting providers, or other third-party services.

Third-party services are not controlled by us, and we are not responsible for their availability, accuracy, security, content, functionality, policies, or practices.

Third-party websites and services may change their interfaces, security measures, terms, APIs, or functionality without notice. Such changes may affect the operation or effectiveness of BrowserShield.

Your use of third-party services may be subject to separate terms and privacy policies imposed by those third parties.

10. Privacy

Your use of BrowserShield is also subject to our Privacy Policy, which explains how information may be collected, processed, stored, and disclosed in connection with the Service.

Our Privacy Policy is incorporated into these Terms by reference. You should review the Privacy Policy before using BrowserShield.

11. Data and Security Analysis

To provide certain security features, BrowserShield may process information associated with websites, URLs, downloads, webpage content, browser activity, or user interactions, as described in our Privacy Policy.

Certain information may be transmitted to our servers or third-party service providers for security analysis, classification, or other processing.

We use reasonable measures designed to protect information processed through the Service; however, no method of transmission, storage, or security technology can guarantee absolute security.

You acknowledge that the use of any internet-connected security service involves inherent security and privacy risks.

12. Subscriptions and Payments

Certain BrowserShield features may require a paid subscription. If you purchase a subscription, you agree to pay all applicable fees presented to you at the time of purchase.

Unless otherwise stated at the time of purchase, subscriptions may automatically renew at the applicable renewal interval until canceled. You authorize the applicable payment provider (e.g., Stripe) to charge the payment method associated with your subscription for recurring fees.

Subscription prices, features, and billing intervals may change from time to time. Where required by applicable law, we will provide advance notice of material changes.

You may cancel your subscription at any time. Cancellation generally prevents future renewal but does not necessarily entitle you to a refund for a previously charged subscription period, except where required by applicable law or expressly stated otherwise.

13. Refunds

Refund eligibility is determined by the refund policy presented at the time of purchase and applicable law.

Nothing in these Terms limits any mandatory refund or cancellation rights provided to you under applicable law.

14. Acceptable Use

You agree not to use BrowserShield:

• For any unlawful, fraudulent, abusive, or malicious purpose;
• To interfere with or compromise the Service or another person’s device, account, network, or data;
• To circumvent security controls or access restrictions;
• To facilitate unauthorized access to systems or accounts;
• To distribute malware or other malicious code;
• To infringe the rights of others;
• To violate applicable privacy, intellectual-property, or other laws; or
• In any manner that could reasonably harm the Service, our users, or third parties.

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms or used the Service in a manner that creates security, legal, or operational risks.

15. Intellectual Property

The Service, including its software, design, interfaces, graphics, trademarks, logos, documentation, databases, and other content, is owned by or licensed to the BrowserShield project and its operators, and is protected by applicable intellectual-property laws.

Except for the limited license expressly granted under these Terms, no rights are granted to you.

“BrowserShield” and associated names, logos, designs, and branding are proprietary marks of BrowserShield and its operators. You may not use our branding without prior written permission.

16. User Feedback

If you provide suggestions, ideas, recommendations, bug reports, or other feedback regarding BrowserShield, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable right to use, reproduce, modify, distribute, and otherwise use that feedback for any lawful purpose without compensation or attribution to you.

Providing feedback does not transfer ownership of your personal information or confidential information to us.

17. Service Availability and Modifications

We do not guarantee that BrowserShield will always be available, uninterrupted, secure, or error-free.

The Service may be unavailable or impaired due to maintenance, updates, technical problems, internet connectivity, browser changes, operating-system changes, third-party service interruptions, security incidents, or circumstances beyond our reasonable control.

We may update, modify, suspend, or discontinue all or part of the Service at any time. We are not obligated to maintain compatibility with every browser, operating system, device, website, or third-party service indefinitely.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

WE DO NOT WARRANT THAT:

• BROWSERSHIELD WILL DETECT OR BLOCK EVERY SECURITY THREAT;
• THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
• SECURITY CLASSIFICATIONS WILL ALWAYS BE ACCURATE;
• AI OR AUTOMATED RESULTS WILL BE ACCURATE OR COMPLETE;
• THE SERVICE WILL BE COMPATIBLE WITH EVERY DEVICE, BROWSER, OPERATING SYSTEM, OR WEBSITE;
• THE SERVICE WILL PREVENT DATA LOSS, MALWARE, PHISHING, FRAUD, OR OTHER HARM; OR
• THE SERVICE WILL MEET ALL OF YOUR PARTICULAR REQUIREMENTS.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BROWSERSHIELD, ITS OPERATORS, DEVELOPERS, AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOSSES ARISING FROM OR RELATED TO:

• MALWARE OR VIRUSES;
• PHISHING OR FRAUD;
• MALICIOUS OR COMPROMISED WEBSITES;
• MALICIOUS DOWNLOADS;
• DATA LOSS OR CORRUPTION;
• UNAUTHORIZED ACCESS OR SECURITY INCIDENTS;
• INACCURATE OR INCORRECT SECURITY CLASSIFICATIONS;
• FAILURE TO DETECT OR BLOCK A THREAT;
• FALSE POSITIVE OR FALSE NEGATIVE DETECTION;
• AI-GENERATED OR AUTOMATED RESULTS;
• THIRD-PARTY SERVICES;
• SERVICE INTERRUPTIONS; OR
• CHANGES TO BROWSERS, OPERATING SYSTEMS, WEBSITES, OR THIRD-PARTY SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BrowserShield, its operators, developers, affiliates, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your violation of these Terms;
• Your misuse of the Service;
• Your violation of applicable law or third-party rights; or
• Your intentional or negligent conduct in connection with the Service.

21. Suspension and Termination

We may suspend or terminate your access to the Service if:

• You violate these Terms;
• You engage in fraudulent, abusive, or unlawful activity;
• Your use creates a security or operational risk;
• Required by law or a governmental authority; or
• We discontinue the applicable Service.

You may stop using BrowserShield at any time and may uninstall the software from your devices.

Upon termination, provisions that by their nature should survive termination will continue to apply, including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute-related provisions.

22. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we may provide notice through the Service, our website, or other reasonable means.

Your continued use of BrowserShield after the effective date of revised Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

23. Governing Law and Dispute Resolution

These Terms will be governed by and interpreted in accordance with applicable laws, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts in the operator’s principal place of operation, except where mandatory consumer protection laws specify otherwise.

24. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

25. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly incorporated by reference, constitute the entire agreement between you and BrowserShield regarding your use of the Service and supersede prior or contemporaneous agreements concerning the Service.

26. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.
